It may not be very romantic, but there are various financial practical matters that need to be thought about before marriage such as the ownership of assets.  Most people don’t realise that upon marriage each individual’s finances become one ‘family pot’ unless an agreement has been recorded to reflect otherwise. A pre or post-nuptial agreement could settle any issues before they arise, protecting all parties’ interests regardless of future circumstances.

What is a Pre-Nuptial Agreement?

A pre or post-nuptial agreement is simply a legal document that clarifies the parties’ agreement as to how assets will be divided if you and your partner split up.

What is the difference between a Pre-Nuptial and Post-Nuptial Agreement?

Simply, a pre-nuptial agreement is established and signed before you get married, while a post-nuptial agreement is signed during marriage. The latter may be a consideration if the relationship has shown signs of fracture or if you have previously separated with your partner and are back together or, where you didn’t have time to do a pre-nuptial agreement.  There are very specific legal requirements to such agreements being legally binding.

In the case of a pre-nuptial agreement, it should be discussed and signed by you and your partner at least 8 weeks before your wedding day.
