General Data Protection Regulations: Higher penalties for breaches of Data Protection

Deborah Pegg, Solicitor inĀ both Astle Paterson’sĀ Media, Entertainment, TV & Film and Commercial departments discusses the new General Data Protection Regulations (GDPR).

Deborah said, ā€œThe new General Data Protection Regulations will come into force in May 2018 across the whole of Europe, regardless of Brexit.

The GDPR is an enhanced version of the Data Protection Act but the penalties for breaches of the GDPR are significantly higher.ā€

Deborah continued, ā€œThe GDPR will affect all companies, not only in relation to data collected from clients, customers and other third parties, for example, marketing, but also in relation to employees, contractors and the like.

Even when selling a business there may be considerations that have to be made before sharing certain information, for example, about your employees, with a prospective buyer.ā€

Deborah concluded, ā€œCompanies should ensure that they are already familiarising themselves with the regulations to ensure that they understand not only what data they hold and why but also that adequate policies and procedures are put in place to deal with the requirements of the new regulations well before the May 2018 deadline.ā€
