Since the 1990s, solicitors and separating partners have been pushing for legislation to bring in so-called “no-fault” divorces. It was recently announced that the implementation of no-fault divorces has been yet again delayed, leading to much dismay. What Are No-Fault Divorces?

When a couple divorce, generally there are two options: either one spouse has to prove a significant fault with the behaviour, conduct, or actions of the other spouse that has led to the process being initiated, or both partners have to wait for a long period of time for the divorce to be processed through the court system.

The concept of the no-fault divorce is a simple one. It’s a divorce whereby both parties agree that neither is at significantly more fault than the other, and they agree to part amicably. Sometimes, relationships just don’t work out long-term; people drift apart and fall out of love. It’s just one of the facts of life. No-fault divorces seek to acknowledge this and give partners an option to be grown up and civilised while officially dissolving the relationship.

Why Has The Implementation Been Delayed?

The official reason cited for the delay is to allow appropriate time to develop and test the digital portion of the service. For many, this won’t be seen as an acceptable excuse, considering this legislative change has been in the pipeline for over two decades. For others, it will at least be an indication that the change is indeed coming, albeit not as soon as many will have hoped for.
