Dishonesty during divorce proceedings: Husbands and wives beware

Rayhana Kausar, Graduate Chartered Legal Executive in Astle Paterson’s Family Department, discusses the recent cases heard before the Supreme Court regarding the potential effects of former husbands and wives being dishonest within divorce proceedings.

Rayhana said “Two ex-wives who say they were duped into accepting unfair divorce settlements have recently appeared before the Supreme Court to fight a case that should act as a precedent on how dishonesty within divorce proceedings is from then on treated in family courts.

Following previous divorce settlements, the two women have alleged that their former husbands were dishonest to the Court regarding their financial position.

In the first case, a criminal trial revealed the husband had intentionally failed to disclose his finances within the divorce proceedings where a settlement was agreed between the husband and wife based on that, incorrect and false, information.

In the second case a 50:50 split was agreed between the parties but it has later emerged that the husband misled the wife and the Court over the value of his business and his intention to float his Company on the stock-market.”

Rayhana concluded “If the Supreme Court overrules the previous divorce settlements in these two cases, we may see many more people trying to re-open their final settlements based on their former spouses’ dishonest conduct.”
