Rayhana Kausar, Graduate Chartered Legal Executive in Astle Paterson’s Family Department, discusses the recent Court of Appeal decision in which it was said that divorcees with children over 7 years old should go to work.
Rayhana said “A Judge has told the ex-wife of a millionaire racehorse surgeon to get a job as she has no right to be ‘supported for life’ at the expense of her former husband.
Mother-of-two and former riding instructor, Mrs Wright, 51, chose not to work when her 11-year-marriage to Mr Wright ended in 2008, protesting that having to care for a 10 year old and the couple’s older daughter was an inherent restriction on her ability to develop any kind of earning capacity.
Lord Justice Pitchford said ‘there is a general expectation that, once children are in Year Two [at school], mothers can begin part-time work and make a financial contribution. The time had come to recognise that, at the time of his retirement, the husband should not be paying spousal maintenance.’”
In conclusion, Rayhana said “The ruling will have a significant impact on future big-money divorce cases.
The decision was the latest where judges have made it plain that spousal maintenance is no longer a meal ticket for life. The fact that it is a decision on Appeal gives it greater weight.
Unless the family’s swimming in millions of pounds, the luxury of the stay-at-home mum is fast being confined to history.
One way to safeguard yourself is to give consideration to entering into a prenuptial agreement before the wedding to prevent your spouse running off with a large share of your wealth.”
