Fiona Woodall, Student Member of the Institute of Chartered Legal Executives Civil Litigation & Dispute Resolution Department, discusses the Government proposals to generate more income through the Court System by the increase of Court fees for many Civil Litigation matters.
Fiona said “Among matters included in the consultation, it is proposed that fees for Possession Claims issued by a Landlord or Mortgage lender in the County Court in paper format should be increased from £280.00 to £355.00 and claims issued on the Possession Claims Online (PCOL) facility be increased from £250.00 to £325.00.
Further, Court fees on medium and high value money claims of £10,000.00 and above could be increased from the current fees to that 5% of the total amount claimed in the proceedings. For example a claim for £25,000.00 may cost £1,250.00 to issue – up from that of £675.00.”
Fiona concluded “These increases represent a large value increase in the cost of issuing a claim in the Courts, and there is concern that any increase may deter people from pursuing claims.”
