Solicitors and Confidentiality

Jean Paterson, Solicitor and Director at Astle Paterson discusses the Solicitors’ fundamental duty of client confidentiality.

Jean said “Client confidentiality is a core obligation applicable to Solicitors.

Solicitors are expected to maintain high standards of professional conduct, and it is crucial that clients can rely on their Solicitor to keep their affairs confidential.

It is of particular note that this duty continues even after the end of the contract between the Solicitor and the client – even after the death of the client.”

Jean continued “Solicitors are regulated by the Solicitors Regulation Authority (‘SRA’).  The SRA’s guidance to all Solicitors in England & Wales makes it clear to Solicitors ‘Protection of confidential information is a fundamental feature of your relationship with clients.   It exists as a concept both as a matter of law and as a matter of conduct.’

The general rule is that a Solicitor simply cannot talk about their client’s affairs with anyone outside their firm – unless the client gives their consent, or disclosure of certain information is required or permitted by law.”
