Selling your house

Your decision to sell your home or move homes will be one the biggest financial decisions you ever make. We will consider the full process including the important part your solicitor will play to ensure an efficient and stress free result.

First things first:

 

  • Have you chosen an estate agent?
  • If so, we need to know their name and address as soon as possible. We suggest you ask for a full quotation of their charges before signing any agency agreement.
  • Have you made any structural alterations and additions to the property? If so we will need the appropriate planning consents and building regulation approvals.
  • We also need details of work done such as damp proof courses, timber treatment, cavity wall insulation, central heating and double glazing, together with their specifications and the guarantees they carry.
  • We also need to know details of your lender and their account number. If there is no mortgage we will need to know the whereabouts of the title deeds.

 

The legal side of selling your home

 

  • Before exchange of contracts
  • We obtain your title deeds and documents and prepare the contract for sale. This is sent to the buyer's solicitors with all necessary documentation.
  • We will let ask you to complete a property information form and fixtures fittings and contents list, even if buyers have not been found. If the property you are selling is leasehold we will let you have an additional property information form for completion.

This will save time when an offer is eventually accepted. We will also clarify any detailed requirements you may have on your sale.

  • We will arrange with you the moving (completion) date

  • We receive the buyers signed contract together with the deposit.

  • The copy of the contract signed by you is then sent to the buyers solicitors. At this point contracts are exchanged and binding.

 

  •  After exchange of contracts

 

  • We will obtain the figure needed to clear any borrowing
  • We will approve the transfer deed and ask for your signature

 

 

  • After completion

 

  • We will collect the balance of the sale price

  • We will pay off any outstanding borrowing

  • We will pay any agents fees and deduct any costs

  • You will receive the surplus sale proceeds or they will be used towards your purchase (if any)

  • The deeds will be passed to the buyers solicitors
